A pre-employment background check is not a full-scale investigation into someone's private life. Instead, the process
is used to confirm the information provided on an application, and that all relevant licenses, certifications, and degrees are in
good standing.
The term "comsumer reporting agency" means any person which, for monetary fees, dues, or on a cooperative nonprofit
basis, regularly engages in whole or in part in the practice of assembling or evaluating consumer credit information or other information
on consumers for the purpose of furnishing consumer reports to third parties, and which uses any means or facility of interstate commerce
for the purposes of preparing or funishing consumer reports. (FCRA, subsection 603)(C)(f).
Comsumer reporting agencies must take
measures to ensure accuracy of the report. Whenever a consumer reporting agency prepares a consumer report it shall follow reasonable
procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. (FCRA,
subsection 607)(b).
For employment purposes, the access method most often used is to physically visit each relevent county courthouse
and look up the record. If there is a potential match, the researcher can look at the case details and confirm identifiers
to be certain it is indeed their person.
The purpose of the FCRA is to facilitate the flow of essential information concerning
an individual's background, while at the same time protecting the individual's privacy rights and minimizing the risks of an innacurate
report.
As part of our service we will physically review reports and data and remove anything that is clearly not reportable
per state regulations in order to protect the employer from impermissable data.
